YoBa Terms and Conditions Policy Waiver

I agree that I am personally responsible for my safety and actions while using Yoba Studio. I agree to comply with all YoBa policies and rules, including but not limited to all YoBa Studio policies, guidelines, signage, and instructions.

1. Because YoBa Studio is open for use by other individuals, I recognize that I am at higher risk of contracting COVID-19. With full awareness and appreciation of the risks involved, I, for myself and on behalf of my family, spouse, estate, heirs, executors, administrators, assigns, and personal representatives, hereby forever release, waive, discharge, and covenant not to sue YoBa Studio and it’s affiliates, from any and all liability, claims, demands, actions, and causes of action whatsoever, directly or indirectly arising out of or related to any loss, damage, or injury, including death, that may be sustained by me related to COVID-19 whether caused by the negligence of the Released Parties, any third-party using YoBa Studio, or otherwise, while participating in any activity while in, on, or around YoBa Studio and it’s tools, equipment, or materials.
2. By signing below I acknowledge and represent that I have read the foregoing Waiver of Liability, understand it and sign it voluntarily as my own free act and deed, including without limitation the Release of Liability and Indemnification requirements contained in this document. I am at least eighteen (18) years of age and fully competent; and I execute this document for full, adequate, and complete consideration fully intending to be bound by the same. I agree that this waiver of Liability shall be governed by and construed in accordance with North Carolina law. If I have been exposed, tested, or traveled to an area with high risk or proven and confirmed cases, I agree to remove myself from YoBa studio and remain at home. I agree that I will not return to YoBa studio until all sickness, or risk of sickness has been fully eliminated from my vicinity. This waiver remains in effect until the State of North Carolina and all COVID-19 related mandates are fully resolved and documented.
3. I understand that YoBa Studio might video record or take photos at any class I attend for their YoBa At Home program, advertisements or other media activities (such as social media or the internet). I hereby grant permission for YoBa Studio the rights of my image, in video or in still, and of the likeness without the expectation of compensation or other remuneration now or in the future. likeness fully consent that presence at this class might be recorded and I agree to

Photographic, audio or video recordings may be used for ANY USE which may include but is not limited to: Presentations; Courses; Online/Internet Videos; Media; News (Press); Live Streaming. There is no time limit on the validity of this release nor is there any geographic limitation on where these materials may be distributed
